Terms of Use

Alcides E. Rosaura Diniz Foundation (“ARD”) is as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (“IRS”), and has an IRS identification number of 81-4940010. 
Contributions to ARD may be tax-deductible to the fullest extent perm7itted by law. Please check with your personal tax advisor regarding the deduction of your gift.

Gift Acceptance Policy

Acceptance of any contribution, gift or grant is at the discretion of the ARD. ARD will not accept any gift unless it can be used or expended consistently with the purpose and mission of ARD.
No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.
ARD will refrain from providing advice about the tax or other treatment of gifts and encourages donors to seek such advice and guidance from their own professional advisors.
ARD will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of ARD.
Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for ARD.
ARD will provide acknowledgments to donors meeting IRS substantiation requirements for property received by the charity as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by ARD.
ARD will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, ARD will restrict information about the donor to only those staff members with a need to know.

Online Donations

ARD requests information from the visitor on our donation form. A visitor (also “donor” or “you”) must provide contact information (such as name, email and mailing address) and payment information (such as credit card number and expiration date). This information is used for billing purposes and for sending receipt of the donation.
 If ARD has trouble processing a donation, the information is used by ARD to contact the donor. ARD will not share the visitor’s name and contact information with any third party. Financial and credit card information are never disclosed.
ARD wants to make it clear that ARD is not willing to accept donations earned through illegal and unlawful means.

Credit Card Policy

When you donate to ARD, your credit card information is encrypted for your security by Heartland Secure, The payment gateway (powered by Heartland) uses EMV, end-to-end encryption and tokenization to protect the security of your transaction and the confidentiality of your personal information. This makes it extremely difficult for anyone else to intercept the credit card information you send to ARD.

Cancellation & Refund Policy

 No cancellation for the donated amount by any donor will be entertained. The donation will be used by ARD to support its mission. ARD does not compel any person or organization to donate money, rather it depends on one’s own wish whether he/she/it is willing to contribute towards ARD’s mission.
But, as far as refunds are concerned, ARD will consider a partial refund in case you donated an amount by mistake. Please contact us within 15 days from the date of your donation if you identify an error in the amount of payment or to report unauthorized usage of your credit or debit card. Generally, refunds are returned using the original method of payment.  For example, if you made your donation by credit card, your refund will be credited to that same credit card. ARD is committed to use its reasonable efforts to safeguard the security of the user information that is collected and retained on our server. Nevertheless, ARD acknowledges that, in spite of ARD’s committed effort, some determined individual may still develop data-mining and other methods to uncover such information and disclose it. For this reason, ARD can make no guarantee against unauthorized access to information provided in the course of using this website. ARD reserves the right to make any change or update concerning the above policies, so ARD requests that you visit this page from time to time.


Terms of Service


These Terms constitute a binding agreement between all users and ARD FOUNDATION in relation to your use of service and that’s why you should read them carefully. They represent the conditions that users and other entities shall observe in their interaction with our services and ARD FOUNDATION.

I – Accepting the Terms

In order to use ARD FOUNDATION’s services, the user should first of all agree to these Terms of Service. If you don’t take this step, you may not use our services.
From the moment you accept these Terms, you acknowledge that ARD FOUNDATION will provide their services in accordance with these Terms of Service. However, these Terms can never be accepted by anyone who’s not old enough to benefit from our services or by anyone who is unable to receive and use our services, under the laws of the country in which the user is resident or accesses our services.
In order to protect our users, we advise you should print off or save a local copy of the Terms for your records.

II – Changes to the Terms

ARD FOUNDATION reserves the right to make changes to these Terms from time to time. The modified version of these Terms will be posted in this site. The changes to the terms will become effective from the moment of notification.
If you do not agree with the modified terms, you shall stop using our services. In other way, your continued use will constitute your acceptance of the changes to the Terms.

III – Using software, products and internet sites of ARD FOUNDATION

To be able to use our services, the user must have internet connection. In order to access some features of the services created by ARD FOUNDATION, the user will have to create an account. The information used for registration should be specific. The user must notify ARD FOUNDATION whenever he/she verifies any breach of security or unauthorized use of the account.
Each user agrees that will be solely responsible to ARD FOUNDATION and to others for all activity that occurs under the using of service.
The user agrees with software updates in accordance with these Terms of Service, unless other terms follow the updates.
The users acknowledge and agree that ARD FOUNDATION may stop permanently or temporarily providing the service thanks to upgrades and maintenance of software.

IV – General restrictions on use

ARD FOUNDATION grants you permission to access and use our services and you agree that your failure to any of these Terms shall constitute a breach:
  1. The user will not distribute any part or parts of the website, of the services or any content, in any medium without ARD FOUNDATION’s prior written consent, unless ARD FOUNDATION allows such distribution through functionality offered by the services;

  2. The user will not change or modify any part of the website or of the service;

  3. The user agrees not to disable or interfere with any security related features of the services;

  4. The user agrees not to collect any personal data of any user of the website or other service;

  5. The user will not copy, reproduce, distribute, transmit, display, sell, license or otherwise exploit any contents for any other purposes without prior written consent of ARD FOUNDATION.
The user declares that he will comply all the time with all of the other provisions of ARD FOUNDATION’s Terms.
ARD FOUNDATION has no responsibility to user or to any third party for breach of the user’s obligations under these Terms and for the consequences. The user agrees that is solely responsible for any breach of the obligations under these terms.

V – Contents

ARD FOUNDATION does not guarantee any confidentiality with respect to published content.
The user agrees and acknowledges that is solely responsible for the contents and for the consequences of his publications and ARD FOUNDATION disclaims all liabilities in connection with published content.
You warrant that you have all necessary licenses, rights, consents and permissions required to share the contents with our services.
The user will not post or upload any content possibly unlawful under the laws of the country in which the user is resident or in which it would be unlawful for ARD FOUNDATION to use in connection with the provision of the service.
On becoming aware of any potential violation of these Terms, ARD FOUNDATION will decide if the contents observe or do not observe the requirements expressed in this document. If the contents do not observe these Terms, ARD FOUNDATION has the right to remove those contents and/or cancel the account of the user.
The user understands and acknowledges that in using our services, may be exposed to contents that are inaccurate, offensive or objectionable. In that case, the user agree to waive any legal or equitable rights or remedies against ARD FOUNDATION with respect to any such content.

IV – User license granted

When you upload or post contents in our services, you give us a non exclusive, royalty free, transferable license to use, reproduce, distribute, display and perform those contents with the provision of the services. You also grant to each user of our services a non exclusive, royalty free license to access to you contents from the website to use, reproduce, distribute, display and perform those contents to the extent permitted by the functionality of the Service and under these Terms.

V – ARD FOUNDATION content on the website

With the exception of Content submitted to the service by the users, all other content on the service is either owned by or licensed to ARD FOUNDATION, and is subject to copyrights, trade mark rights and other intellectual property rights.

VI – The end of your relationship with ARD FOUNDATION

If a user breaches any provision of these Terms, ARD FOUNDATION has the right to terminate the relationship.
ARD FOUNDATION may also terminate the relationship with a user if ARD FOUNDATION is required to do so by law.
ARD FOUNDATION has the same right when the provision of our services is no longer allowed in the country in which you are a resident or from which you use the services.

VII – Responsibility

You agree and acknowledge that ARD FOUNDATION shall not be liable to you for any indirect losses and damages like any loss or profit, any loss of goodwill/opportunity or any loss of data suffered which may be incurred by you.
The user agrees and acknowledges that if any court, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

VIII – Final Provisions

The user acknowledges that read these Terms of Service and understands the rights, liabilities, conditions and terms established.
